CHAPTER 1

General Dispositions

1.1 The present document establishes the main rules and principles of administration of names in the top-level domain md.
1.2 The document establishes the authorities which are responsible for the strategy and the administration of names in the top-level domain md., their functions, obligations and responsibilities.

1.3 The document determines the way of payment for the registration and administration of the names in the top-level domain md.

1.4   Here are the definitions of the notions used in this document:

Top-level domain md. (first level domain) - top-level domain name appointed by IANA;

Sub-domain name ( second level domain) - second level domain name in the top-level domain .md who’s address in the Internet has the form “w.w.w.{second level domain name}.md “;

The administration of the domain names- establishing  rules of utilization of the domain name , taking care of it’s technical state and of the payment of fees for offered services;

Registration of domain names- the process through which an entity or a person obtains a domain name and the registration of the necessary information in in the data base of the national Registration. Registration of the domain names allows a person or an entity to use the domain name during a determined period of time respecting certain conditions and paying for the offered services;

The National Registrar - state enterprise working in informatics which has the function to administrate the domain names in the top-level domain md., which owns and coordinates the functioning of at least two servers of the domain name ( primary and secondary DNS) which maintain the attributed domain name and assures a connection to Internet;

Dealer- an entity or a juridical person authorized to prepare the registration of the domain names in the top-level domain md. on the territory for which it is authorized;

Registrant- an entity or a person who owns a registered name in the top- level domain md. and who has the right to solicit, to modify and to revoke  the data of registration of the domain name from the attributed domain.

CHAPTER 2

            Authorities, their functions and obligations.

2.1 The authority which is responsible for the politics and strategy of administration of domain names in the top-level domain md. is the Ministry of Transport and Telecommunications , that will be named further Ministry .

The Ministry promotes the politics and the strategy of administration of domain names in the top-level domain md. and has the following functions:

2.1.1 to choose the national registrar of top-level domain .md;

2.1.2 to modify the list of subdomain names from the top-level domain .md presented in annexes 1 and 2, in which the registration is free;

2.1.3 to approve the plan and the financial reports of distribution of financial means from the top-level domain .md Fond  and to supervise the way this plan is carried out;

2.1.4  to represent Moldova at the International Forums concerning the top-level domain .md;

2.1.5 to sign international agreements and to coordinate the signing of contracts related to the top-level domain .md;

2.2 The authority responsible for the regulation for the activity and implementation of the national strategy of administration of names in the top-level domain .md is the National Agency for Settlements (Regulations) in Telecommunications and Informatics, which will be further called Agency.

The Agency has the following functions:

2.2.1 to approve, after consulting the Government, the tariff for the services fof administration of names in the top-level domain .md;

2.2.2 to regulate the administration of names in the top-level domain .md;

2.2.3 to control the quality of services related to administration of  names in the top-level domain .md;

2.3 The Authority which has the function of National Registrar and administration of names in the top-level domain .md is appointed by the Ministry. The national Registrar has the exclusive right to registration subdomain names in the top-level domain .md.

The national Registrar or the authority responsible for the administration of  names in the top-level domain .md has the following functions:

2.3.1 to determine the subdomains from the top-level domain .md, presented in the anexes 1 and 2, were the registration is free, and to approve them at the Ministry;

2.3.2 to hold and administrate the Register of registration of names in the top-level domain .md;

2.3.3 to ascribe, registre, renew, revoke, modify the name registration data in the top-level domain .md;

2.3.4 to supervise dealers’ activity, to offer help and to make! methodology control on the registration of names in the top-level domain .md; 

2.3.5 to participate to the solution of disputes;

2.3.6 to have international activity regarding the administration of names in the top-level domain .md, in accordance with the authorizations form the Ministry.

The national Registrar of the names in the top-level domain .md has see that the regulations of IANA/ICANN are respected and the here presented document.

2.4 Authorities which have the functions of dealers lead the activities necessary for the preparation of the registration of names in the top-level domain .md in the territory which they have the authorization for, in accordance with the terms of the contract concluded with the national Registrar.

 The dealer has the obligation to promote the image of the Republic of Moldova in the Internet and has the following functions and obligations:

2.4.1 to asses the market;

2.4.2 to look for potential registrants;

2.4.3 to organize the registration process and provides! publicity;

2.4.4 to conclude  the necessary documents in order to obtain the registration;

2.4.5 to collaborate with the national Registrator in the process of registration, modification, or withdrawal of subdomain names;

2.4.6 to apply and respect the regulations of IANA/ICANN and the present document;

2.4.7 to pay fees and conclude monthly reports, in accordance with the contract concluded with the national Registrar;

2.4.8 to carry out all the operative instructions given by the national Registrar in order to respect the terms of the contract;

CHAPTER 3

Principles and modality of registration

3.1 The registration is made in accordance with the principle “ the first to come, is the first to be served”.

3.2  A registrant can own more than one name. The attributed name is not something to be sold or bought: the name attributed to an entity or person cannot be sold by it to another person or entity. The national Registrar has the right to revoke the name in accordance with IANA/ICANN rules regarding the registration and the rules listed in this document;

3.3 The procedure of registration, modification, canceling is determined by the IANA/ICANN rules regarding the registration of names in a higher level domain.

CHAPTER 4

The top-level domain .md Fond. Tariffs.

4.1 The registration of subdomain names listed in the annexes 1 and 2 is free.

4.2 The registration of subdomain names except those listed in annexes 1 and 2 is made by the national Registrar for a fee, in accordance with the tariffs established by the Agency.

For the dealers the payment is made in accordance with the articles 2.4.7 of this document.

4.3 The Agency approves the tariffs for the registration, maintaining, and administration of subdomain names in the top-level domain .md on the territory of the Republic of Moldova.

 The applied tariffs are published and installed on the Internet by the national Registrar.

4.4 The national Registrar originates the top-level domain .md Fond, where, in a special account, are accumulated the financial means obtained from the services of administration of names from the top-level domain .md.

4.5 From the Fond there will be alloted monthly , financial resources

  for the national Registrar to maintain and conduct the top-level domain .md, in accordance with the budget of costs. The budget of costs, necessary to the national Registrar for this kind of works, has to be approved by the Ministry.

4.6 The financial means accumulated in accordance with the article 4.4 will be transferred in the state budget, except the means necessary for the activity of the national Registrar in accordance with the article 4.5., the extra budgetary Fund of informatisation for financing the objectives of the national strategy of informatization of society, regulation payments in accordance with the law of telecommunications nr.520-XIII from 7.07.95 and the rules of the  National Agency for Regulations in Telecommunications and Informatics, approved by the Republic of Moldova Government’s decision  nr.843 from 19.08.2000 and the financial means necessary for creating, maintaining, and  current up-dating of the Official Page of the Republic of Moldova on the Internet.

CHAPTER 5

Obligations and responsibilities   

5.1 The dealers and the national Registrar are obligated to make the registration fair without discrimination,  according to the principle “ the frist to come, is the first to be served, if the Registrant has done everithing that was requested from him. The national Registrar has to lead his activity in accordance with the rules of this document and the IANA/ICANN regarding the top-level domains.

5.2 Dealers have to respect the rules of this document and the IANA/ICANN rules regarding top-level domains.

5.3 The national Registrar, dealers are not responsible for the breach by the registrant of the right to the trade mark and for conflict situations arising from the breach of these rights.

5.4 The registration or administration of subdomain names which contain obscene or offensive images, or images that disparage the Republic of Moldova or other states, call to violence or can harm the image of the Republic of Moldova on the international plan. The use of subdomain names in ilegal activities and activities forbidden by international conventions, is not allowed.

5.5 In case of a breach of the article 5.5 of this document the national Registrators to withdraw the license of these subdomains, depriving the registrant of the right to re-registre it.

ANNEX I

             The List of subdomains attributed to State Authorities

In which registration is free of charge

 The registration of subdomain names of the top-level domain .md can be made only for the authorities of central state public administration and it’s employees:

1. Prm.md, Presedintie.md

2. Prl.md, Parlament. md

3. Gov.md, Guvern. md

4. Academic and Educational institutions financed intirely from the state budget.

These subdomains cannot be used for commercial purpose.

   ANNEX II

The List of geographical subdomain names attributed to the local public administration authorities, in which the registration is free of charge

The registration of the subdomain names of the top-level domain .md is made only for authorities of local public administration, it’s employees, other local institutions financed from the state budget:

These subdomains cannot be used for commercial purpose.

ANNEX III

The List of subdomain names Generics from top-level domain .md

com.md - in this subdomain are registered the commercial entities (companies) from Republic of Moldova ( juridical persons) -the registration is for a fee;

srl.md- in this subdomain are registered the the juridical persons form the Republic of Moldova who have the status of   “         - registration for a fee;

sa.md-  in this subdomain are registered  juridical persons from the republic of Moldova which have the status of    “      - registration for a fee;

net.md- in this subdomain are registered juridical who are internet providers in the Republic of Moldova, owners of  computer nets- registration for a fee;

org.md- in this subdomain are registered all the organizations that are not included in the in other named fields, these can be charity organizations, trade unions, non-governmental organizations, political groups, educational councils, professional institutions from the Republic of Moldova - registration for a fee;

acad.md - in this subdomain are registered the academic and educational institutions from the Republic of Moldova, that universities, colleges, schools, organizations. Academic and educational institutions financed from the state budget are registered for free, others for a free.
